In Indiana all surety bail bonds require 10% of the total bond amount to be paid before the bond can be posted. The bail bondsman cannot charge any more or any less than 10% as premium. Bond premium is considered earned when the bail bondsmen posts the bond with the county court, clerk, or jail. in all cases the bail premium is not refundable once it has been earned.

In some cases where the defendant is considered to be a higher risk the insurance company might request the bondsman to take cash collateral along with the bond premium. When cash collateral is required it is not considered premium for the bail bond but a separate transaction to further guarantee the defendants appearance. Typically cash collateral can only be returned when the court case is over with and the bail bond has been discharged. If the defendant 'FTA's' or fails to appear in court some or all of the cash collateral will be forfeited and therefor not be eligible for return.
